Temu Teknis Penyidik Perikanan Tahun 2018

<div dir="ltr" style="text-align: left;" trbidi="on"><div style="text-align: justify;">Temu Teknis Penyidik Perikanan di Laksanakan mulai tangga 4 s.d 7 Desember 2018 di Mustika Sheraton Resort & Spa Yogyakarta. Para Peserta terdiiri dari Penydik Perikanan di Ditjen PSDKP, BKIP, dan DKP Propinsi Se Indonesia. </div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Adapun yang menjadi Rumusan Temu Teknis adalah sebagai berikut:</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">Pegawai Penyidik Negeri Sipil Perikanan (PPNS Perikanan) Direktorat Jenderal Pengawasan Sumber Daya Kelautan dan Perikanan (Ditjen PSDKP) sebagai salah unsur aparat  penegak hukum di bidang kelautan dan perikanan dalam kurun 5 (lima) tahun terakhir telah menangani 854 kasus tindak pidana kelautan dan perikanan. Berdasarkan kasus yang ditangani oleh Penyidik Perikanan dari hasil investigasi ditemukan berbagai modus kejahatan tindak pidana perikanan dan adanya tindak pidana lain yang terkait di sektor perikanan.</div><div style="text-align: justify;"><br /></div><div style="text-align: justify;">PPNS Perikanan dalam 5 tahun terakhir cenderung melaksanakan penyidikan atas kasus yang tertangkap tangan, dengan perkembangan modus operandi yang semakin kompleks, bersifat lintas negara, serta adanya tindak pidana lain di bidang perikanan, maka PPNS Perikanan diharapkan lebih berani dalam membangun penyidikan kasus yang berdasarkan pengembangan untuk selanjutnya bisa ditindaklanjuti pada proses penyidikan dengan menggunakan pendekatan multi rezim hukum.</div><div style="text-align: justify;">Menyikapi hal ini, dalam sambutan pembukaan kegiatan, Plt. Direktur Jenderal PSDKP menyampaikan arahan sebagai berikut :</div><div style="text-align: justify;"></div><ol><li>mendalami pengetahuan teknis dan mengupdate pengetahuan perkembangan hukum acara pidana;</li><li>pendalaman dan memperkuat wawasan perkembangan modus perandi TPP dan kejahatan terkait lainnya;</li><li>mendorong pelaksanaan Penyidikan terhadap kasus-kasus yang berdasarkan hasil pengembangan tidak hanya hasil tangkap tangan;</li><li>mendorong PPNS Perikanan untuk kritis dalam mengidentifikasi kasus tindak pidana tidak hanya menggunakan UU Perikanan saja melainkan juga melalui rezim perundang-undangan lain</li><li>penguatan koordinasi dan komunikasi yang lebih intensif dengan aparat penegak hukum terkait dalam pelaksanaan Penyidikan di lapangan khususnya untuk mengidentifikasi tindak pidana lainnya,</li></ol><br /><div style="text-align: justify;">Atas arahan Dirjen PSDKP, maka langkah-langkah konkrit yang dilaksanakan dalam kegiatan ini sebagai berikut :</div><div style="text-align: justify;"></div><ol><li>pemberian materi dan wawasan kepada PPNS Perikanan terkait pendekatan multi rezim hukum dalam penanganan tindak pidana perikanan dan tindak pidana terkait lainnya;</li><li>pemberian materi dan wawasan kepada PPNS Perikanan terkait perkembangan hukum acara pidana; dan</li><li>penyempurnaan Juknis Penyidikan Tindak Pidana Perikanan dalam rangka tindakan preventif untuk mencegah praperadilan yang berpotensi menimbulkan gugatan perdata.</li></ol><br /><div style="text-align: justify;">Adapun rumusan dalam penyempurnaan Juknis Penyidikan Tindak Pidana Perikanan yang dibahas dalam kegiatan ini, sebagai berikut :</div><div style="text-align: justify;"></div><ol><li>mekanisme Pemeriksaan Pendahuluan sebelum proses penyidikan;</li><li>gelar perkara pada saat penyerahan hasil tangkapan oleh Kapal Penangkap (pelimpahan kasus dari instansi / Lembaga Lain);</li><li>klasifikasi kasus tindak pidana perikanan berdasarkan tingkat kesulitan penanganannya;</li><li>penyesuaian atas Putusan MK Nomor 130/PUU-XIII/2015 Tanggal 11 Januari 2017 tentang Surat Perintah Dimulainya Penyidikan;</li><li>penyesuaian atas Putusan MK Nomor 21/PUU-XII/2014 Tanggal 28 April 2015 tentang Bukti Permulaan yang Cukup dan Penetapan Tersangka;
